1. Operator and contract

HonestTake is operated by Daniel Koller, Dammstraße 21/48, 1200 Vienna, Austria. Contact [email protected]. The service begins as a free personal side project. A contract is formed when your registration is accepted and you can access the service. Creating an account means you accept these Terms and the Community Guidelines.

2. Eligibility

You must be at least 18, legally able to enter this agreement, and provide accurate information. Do not create an account for another person or use the service where prohibited by law.

3. What the service does

Members submit dating-profile photos, bios and written prompts for structured feedback from eligible assigned reviewers. The service aggregates responses, labels sample strength, awards credits and supports safety controls. Members may optionally record before and after outcome figures for their own comparison. Feedback reflects individual opinions. HonestTake does not guarantee matches, dates, relationships or any other outcome.

4. Your content and limited licence

You keep ownership of content you submit. You grant Daniel Koller a non-exclusive, worldwide, royalty-free licence limited to hosting, copying, resizing, displaying to assigned reviewers, moderating, securing, backing up and otherwise processing that content only as reasonably necessary to provide the service you requested, comply with law and protect legal rights. The licence ends when the content is deleted, except for technically necessary backup expiry and restricted legal or safety evidence.

This licence does not permit selling your content, advertising with it, facial recognition, or training general-purpose machine-learning models. Any materially different use requires a new legal basis and appropriate choice.

5. Your assurances

You must own submitted content or have all necessary permission. Do not upload minors, intimate or sexual imagery, impersonations, stolen images, unlawful content, or an identifiable person who did not agree. Do not include addresses, contact details or other unnecessary sensitive information in prompts or feedback.

6. Reviewer conduct

Review only content assigned to you. Be specific and constructive. Do not copy, download, screenshot, redistribute, identify, contact, stalk, shame, threaten, discriminate against or sexually harass a user. Do not use content for facial recognition, model training, surveillance or any purpose outside the assigned review. Skip any test you cannot assess fairly.

7. Prohibited use

Do not scrape, enumerate users, evade access controls, automate reviews, manipulate credits, coordinate voting, create abusive or duplicate accounts, upload malware, test vulnerabilities without written permission, reverse engineer private interfaces, or interfere with availability. Do not use HonestTake for illegal, deceptive or exploitative activity.

8. Credits

Free credits are a revocable in-product unit used to launch tests. They have no cash value and cannot be transferred, sold or redeemed. An inviter may receive 10 credits after an invited member completes setup, with rewards limited to 10 successful invitations in any rolling 30-day period. Self-referrals, duplicate accounts and coordinated credit farming are not eligible. We may reverse credits obtained through error, spam, automation, duplicate accounts or low-quality activity. Paid credits are not currently offered. Before enabling purchases we will publish price, tax, refund, expiry, withdrawal and termination terms and obtain any legally required consent.

9. Reports, moderation and appeals

Use the reporting route for potentially illegal, unsafe or non-consensual content. We may remove or restrict content, discard feedback, reverse credits, limit distribution, suspend features or terminate accounts where proportionate to law, these Terms or the Community Guidelines. We may use automated signals, but material moderation decisions are reviewable.

Where required, the affected user will receive a specific reason describing the action, scope, duration, legal or contractual ground, and use of automation. You may appeal by replying to the decision or emailing us with its reference. We may restrict details to protect reporters, investigations, security and others’ rights.

10. Availability and changes

HonestTake is an early-stage project. Features may change, be interrupted or be discontinued. We use reasonable care but cannot promise uninterrupted availability, a minimum number or demographic mix of reviewers, or a dating result. We will not make material retroactive changes without appropriate notice and acceptance where required.

11. Liability

Nothing excludes liability or consumer rights that cannot legally be excluded. Subject to that, each party is responsible for foreseeable loss caused by its breach or negligence. HonestTake is not responsible for a reviewer’s subjective opinion or an independent third party’s conduct unless the operator is legally responsible. The service is not professional psychological, medical, legal, safety or relationship advice.

12. Account ending and data

You may delete your account from Account & Privacy. We may suspend or terminate for material/repeated violations or serious risk. Where practicable, we give notice and an opportunity to appeal. Deletion and limited retention are described in the Privacy Notice. Terms that by nature must survive, including ownership, legal claims and completed enforcement, continue only as necessary.

13. EEA withdrawal right

If you are an EEA consumer entering a distance contract, you may withdraw within 14 days without giving a reason. Email a clear statement to [email protected], identifying the account. You may use: “I hereby withdraw from my contract for HonestTake, concluded on [date], for account [email].” Deleting the account also clearly ends the service. This section will be separately reviewed before paid or immediately performed digital services are introduced.

14. Governing law and disputes

Austrian law applies, excluding conflict-of-law rules. If you are a consumer, this does not deprive you of mandatory protections in your habitual country of residence. Statutory jurisdiction remains unaffected. Contact us first so we can try to resolve the issue. The former EU Online Dispute Resolution platform is no longer available.

15. General terms

If one provision is unenforceable, the remainder continues and the applicable statutory rule takes its place. A failure to enforce once is not a waiver. You may not transfer your account or agreement without consent; the operator will not transfer the agreement in a way that reduces mandatory rights without notice or consent where required.
